Terms of Service

These terms govern your use of TradeHawk. By using the service or subscribing you agree to them.

1. What TradeHawk is

TradeHawk compiles publicly available California public works procurement records — solicitations, plan holder and prospective bidder lists, award records — and presents them as bid intelligence: which projects are open, which contractors are holding plans, and who to contact.

TradeHawk is an information service, not a bidding platform. We do not submit bids, transmit quotes, broker introductions, or act as your agent. We are not affiliated with, endorsed by, or acting on behalf of any government agency or procurement platform.

2. Accuracy — read this part

Our data is derived from third-party public records that we do not control. Records can be incomplete, out of date, or wrong at the source. Contact details change as people move jobs. Plan holder lists change up to bid day.

You must verify anything you rely on. Always confirm bid dates, requirements, addenda and submission rules directly with the issuing agency. Missing a deadline, misreading a scope, or relying on a stale contact is your risk, not ours. We provide intelligence to act on, not a substitute for the official record.

3. Acceptable use

You may use TradeHawk data for your own business development. You may not:

resell, sublicense, publish, or redistribute contact information obtained through TradeHawk;
use it to build or supplement a competing data product;
scrape, bulk-export, or systematically extract the service beyond normal use;
share your account with people outside your company;
send unlawful email — you are solely responsible for complying with CAN-SPAM, the TCPA, and applicable privacy law in your own outreach.

Contact details in TradeHawk belong to real people at real companies. Treat them the way you would want your own estimators treated.

4. Subscriptions and billing

Subscriptions are billed monthly in advance through Stripe unless stated otherwise.
Founding rate: where we have offered a founding price, that price remains fixed for as long as your subscription stays active and uninterrupted.
You may cancel at any time. Cancellation stops future billing; access continues to the end of the paid period.
We do not provide pro-rata refunds for partial months. If the service failed to deliver what we promised, email us — we would rather refund you than argue.
We may change pricing for new subscribers at any time; existing subscribers get at least 30 days' notice before any change affects them.

5. Service availability

TradeHawk is provided on an as-available basis. Our upstream sources are public portals we do not control; if a source changes or becomes unavailable, coverage may change. We do not guarantee uninterrupted service, and we do not promise any specific volume of projects, contacts, or results.

6. No guarantee of outcome

We make no representation that using TradeHawk will win you work, produce bid invitations, or generate revenue. Nothing on our site or in our email should be read as a promise of results.

7. Your data

Information you give us is handled per our Privacy Policy. Notes and saved items you create remain yours; ask and we will export or delete them.

8. Intellectual property

Underlying public records are public. Our compilation, classification, scoring, and presentation of them — and the TradeHawk name and marks — are ours. You get a limited, non-transferable right to use the service while subscribed.

9. Termination

You may stop at any time. We may suspend or terminate an account that breaches these terms, particularly section 3, and will refund any unused prepaid period if we terminate you without cause.

10. Disclaimer and limitation of liability

To the maximum extent permitted by law, TradeHawk is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of content.

To the maximum extent permitted by law, our total liability arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost bids, or lost business opportunity.

11. Governing law

These terms are governed by the laws of the State of California. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in California.

12. Changes

We may update these terms. Material changes affecting subscribers will be notified by email at least 30 days in advance.

Note for the operator, remove before launch: a working draft written to match what TradeHawk actually does, not legal advice. Fill in the mailing address. Section 2 is deliberately blunt about accuracy because the product's core promise is contact data that can go stale — under-promising there protects you and costs nothing. Have counsel review before you scale.
